Texas Real Estate Commission considers updates to broker education and experience requirements

The Broker Responsibility Advisory Committee (BRAC) met on October 15 to review public comments and discuss issues related to transaction coordinators and the completion of the Information About Brokerage Services (IABS) form.

In August, the Texas Real Estate Commission proposed changes to Rule 535.56, which sets education and experience requirements for obtaining a broker license. These changes were recommended by BRAC.

The recommendations include increasing the required experience points from 360 to 720 for a broker’s license and capping the bachelor’s degree credit at 300 hours of real estate-related education. The total required education hours to become a licensed broker would remain at 900. Other proposed adjustments would allow up to 300 hours of the 630 required real estate education hours to be substituted with experience points earned above the minimum requirement, change the calculation of property management experience from per property to per property per year, and modify the brokerage management/delegated supervisor calculation to a points-per-transaction model.

Currently, applicants receive full credit for 630 hours of real estate-related education with a bachelor’s degree and must have at least four years of active experience in the past five years, totaling 360 experience points.

After reviewing feedback from the public, BRAC has recommended that the Commission adopt these proposed changes.

The committee also addressed concerns about transaction coordinators and showing agents providing services for multiple brokerages, noting that this discussion will continue at their next meeting.

In addition, members discussed whether agents are fully completing the IABS form and if incomplete forms create confusion for consumers regarding contact points during transactions. The committee suggested that more educational resources should be provided to license holders on how to properly complete this form.
