Broker-Lawyer Committee recommends adoption of lease forms and withdraws other proposals

The Broker-Lawyer Committee (BLC) convened on October 10 to welcome new members, review public feedback on recent proposals, and determine the status of several form updates. The committee consists of six attorneys appointed by the State Bar of Texas, six members appointed by the Texas Real Estate Commission (TREC), and one public member appointed by the Governor. Members serve six-year terms, except for the public member, who serves a two-year term.

At the meeting, three new appointees were introduced: Kandi Luensmann as a broker member, Kristen Porter as an attorney member, and Kenneth Vall as an attorney member. Ron Walker, who serves as Co-Chair and Broker Member, was reappointed for another term.

The BLC recommended that TREC adopt temporary residential lease forms and a flood plain notice for use with leases at its next meeting in November. These forms had previously been proposed at the August meeting.

The temporary lease forms have been updated in response to Senate Bill 2349, which becomes effective September 1, 2025. The bill exempts temporary residential leases and short-term leases from the requirement to provide landlords with a flooding notice. As a result, TREC revised the Landlord’s Floodplain and Flood Notice and both the Buyer’s Temporary Residential Lease and Seller’s Temporary Residential Lease agreements.

After considering public comments and discussing potential contract changes, the committee decided to request that TREC withdraw other proposals that had been made at the August meeting. These included changes to Paragraph 12, page 10 disclosure, disclosures related to groundwater and surface water rights, and new disclosures regarding conservation easements and windstorm or other insurance. The committee plans to continue discussing these topics at its next meeting scheduled for January 8 and 9, 2026.
